For the sale of fake Huawei screens, a man went to jail and now has to pay several times more than he earned



The “original” screens you bought online are likely fake and substandard products made by small workshops.

A trademark infringement hearing was recently held in China. Since May 2018, Mr. Liu Moucheng has purchased LCD screens and protective glasses with Huawei and Honor logos and other materials for assembly without the permission of the copyright holder. Online retailers Xuanxuan Digital 1, Aishangweier, Wellge Digital Technology, and Shenzhen Hengtai Communication Accessories Center have sold these and other products outside of China.

On October 12, 2020, the Longhua District People’s Procuratorate of Shenzhen City filed a state indictment with the Longhua District Court in this case, and the Longhua District Court ruled the criminal case following a trial. Defendant Liu Moucheng confessed to the crime and was sentenced to three years and six months in prison and a $ 185,000 fine. The criminal sentence entered into force.

Huawei believes that the actions of defendant Liu Moucheng caused huge economic losses to the company, so the company has filed a civil claim for compensation. After the trial, the court found that defendant Liu Moucheng sold 14,139 fake screens, earning about $ 43,000.

In view of the fact that the defendant took the initiative and pleaded guilty to a criminal case, and was already sentenced to a fine of $ 185,000, the court additionally awarded compensation to Huawei in the amount of $ 87,000.
