NSO Group intended to obtain immunity on the basis that it acted as a contractor to a foreign government, but the court rejected this claim. According to District Judge Danielle Forrest, licensing Pegasus software and providing technical support does not exempt the company from liability under federal law, which overrides common law. “Whatever NSO Group’s government customers do with its technology and services, it doesn’t make NSO Group“ an agency or instrument of a foreign government. Thus, NSO Group is not entitled to foreign sovereign immunity, ”Forest explained.
